BY USING THE WEBSITES, YOU EXPLICITLY AGREE THAT YOU ARE AT LEAST EIGHTEEN (18) YEARS OF AGE AND BOUND BY THESE TERMS OF USE. If you do not agree to these Terms of Use, you must immediately exit the Websites and discontinue the use of the Websites and any information, product, or services found therein.
The term “Agreement” shall mean the agreement formed between you and us pursuant to these Terms of Use, any other terms and conditions posted on the Websites, and any other written agreement between you and us, all of which are incorporated herein by reference. CretoSeal provides in depth information about our product line along with many videos showing how to use the products. Please read through this information and view our videos before placing any orders.

MONEY BACK GUARANTEE:

CretoSeal money back guarantee is exclusively for the “DIY Concrete Staining Kit” purchase. One refund per household and or company. Maximum refund amount is $2,970. No other items sold on the Websites qualify for this guarantee. If Customer has applied our products in an unsatisfactory way, which may cause these specific problems:
Stain not adhering to the concrete.
Sealer not adhering to the concrete.
Sealer or stain fading, clouding, yellowing, or changing colors (breathable sealers like Barrier might look cloudy when they get wet. This does not affect the performance of the sealer and is a normal attribute).
Sealer chipping, fish eyeing, cracking, peeling, or flaking up after it has cured.

The aforementioned problems must be throughout the treated area. If these problems are under half (approximately 175 square feet) of the treated area, stain and sealer will be supplied, free of charge, to repair the area.
If the entire treated area has problems as described above, the customer can either receive a refund of 100% of the stain kit costs paid to CretoSeal, OR receive free stain and or sealer to fix the problem areas, up to one year from the purchase date.

In order to qualify for this refund, Customer must: (a) have viewed all of the relevant videos in the “Concrete Staining Training” online course; (b) email CretoSeal at sales@cretoseal.com describing the problem along with at least five high resolution photos of the unsatisfactory areas of the stained and sealed concrete; (c) provide CretoSeal with a copy of Customer’s original sales receipt; and (d) have a valid Venmo or PayPal account if the card used for the original purchase is no longer valid.

CretoSeal money back guarantee does not include damage from “regular wear and tear” which includes: heavy items dragged across the sealed concrete, heavy items dropped onto the sealed concrete, chemicals or food items that have damaged the sealed concrete, or any other damage to the sealed concrete that would be considered “regular wear and tear”.

Processing of the request may take up to 14 business days before the money is refunded.

MODIFICATION OF THE WEBSITE

CretoSeal reserves the right in its sole discretion to change, modify, alter, update, improve, or remove any information or content appearing on the Websites. You agree to pay all charges incurred by you or any users of your account, including all applicable taxes relative to the purchase. AVAILABILITY OF THE WEBSITES

INDEMNITY

  2. Your violation of any law or the rights of a third party; or

REMEDIES

In the case of any violation of our Agreement, CretoSeal reserves the right to seek all remedies available by law and in equity for such violations, including termination of your use of the Websites .

Furthermore, without limiting any other provision in this Agreement, in the event you default under this Agreement, we will have the right to exercise any or all of the following remedies:

  1. We can terminate this Agreement;
  2. We can ban your future use of the Websites; and
  3. We can exercise any and all rights and remedies available to us at law and in equity.

RESOLUTION OF DISPUTES, INCLUDING CONTROLLING LAW AND JURISDICTION

If a dispute arises between you and CretoSeal, we strongly encourage you to first contact us directly to seek a resolution. We will consider reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to litigation.
This Agreement shall be governed and construed in accordance with the laws of the State of Idaho as they apply to agreements entered into and to be performed entirely within Idaho between Idaho residents, without regard to conflict of law provisions. You agree that any Claim or dispute you may have against CretoSeal must be resolved by a court located in Boise, Idaho, except as otherwise agreed in writing by the parties. You agree to submit to the personal jurisdiction of the courts located within Boise, Idaho, for the purpose of litigating all such Claims or disputes.

NOTICES

All notices, including legal notices, are considered served upon CretoSeal when mailed to the CretoSeal address (as listed in the Contact Us section of the Websites) certified mail, return receipt, and received by CretoSeal.

OUR FAILURE TO ACT

Our failure to act with respect to a breach by you or others shall not constitute a waiver of such provision or prejudice the right of either party to enforce such provision thereafter. This Agreement does not intend or create an agency, partnership, joint venture, employee-employer, or franchiser-franchisee relationship.

TERMINATION OF ACCOUNT OR ADVERTISEMENT

Subject to applicable law, CretoSeal reserves the right to refuse service to anyone and to terminate a user’s account at any time.

CONSTRUCTION OF AGREEMENT

If any part of this Agreement is determined to be invalid or unenforceable If any provision of this Agreement is or becomes void or unenforceable by force or operation of law, the remaining provisions shall remain valid and enforceable.
